Bookings Conditions / Terms & Conditions
The Website provides an online accommodation booking service available 24 hours a day. The service allows Users to book or reserve holiday accommodation remotely via the Internet in a simple and direct manner.
These Booking Conditions constitute a legally binding agreement between the User and VILLAREP.
1. IDENTIFICATION OF THE CONTRACTING PARTIES
The booking contract is concluded between the User and VILLAREP (hereinafter, “the Website Owner”), acting as an intermediary and/or provider of holiday accommodation services.
2. ACCEPTANCE OF TERMS AND USER ELIGIBILITY
By completing a booking on the Website, the User declares that:
- They are at least 18 years old
- They have the legal capacity to contract
- They act on their own behalf and on behalf of all persons included in the booking
- They accept these Booking Conditions fully and without reservation
Acceptance of these terms occurs at the moment the booking is confirmed.
3. APPLICABLE LAW AND JURISDICTION
This contract shall be governed by Spanish law, in accordance with applicable European Union consumer legislation.
In the event of a dispute, the parties submit to the jurisdiction of the Spanish Courts, without prejudice to the consumer’s right to bring proceedings before the courts of their place of residence where legally applicable.
4. PRICES, TAXES, AND PAYMENTS
All prices are stated in Euros (€).
Prices include Value Added Tax (VAT) where applicable, but exclude the Balearic Tourist Tax (Ecotax), which shall be payable according to local regulations and added to the booking price.
The Website Owner reserves the right to modify prices at any time. However, the price applicable to the contract shall be the one displayed at the time the booking is confirmed, except in the case of a manifest typographical or technical error.
Payment Schedule
- 30% deposit payable at the time of booking
- Remaining balance payable no later than 60 business days prior to arrival
Failure to complete payment within the stated period may result in cancellation of the booking.
5. NATURE OF THE SERVICE
The User acknowledges that accommodation prices may vary due to location, seasonality, capacity, and services, and that price differences do not necessarily reflect differences in quality.
The Website Owner reserves the right to refuse a booking in the event of prior payment incidents, disputes, or suspected misuse of the service.
6. PROPERTY DESCRIPTION AND USE
Property descriptions, photographs, and information are provided in good faith and for informative purposes. Minor discrepancies may occur due to updates, maintenance, or external circumstances.
The Website Owner shall not be held liable for interruptions in water, electricity, internet, or other utilities caused by circumstances beyond its control.
Maximum Occupancy and Use
- The number of occupants may not exceed the maximum capacity indicated
- Properties are for holiday accommodation only
- Events, parties, commercial use, filming, or similar activities are strictly prohibited unless expressly authorized
Any breach may result in immediate termination of the contract without refund.
7. CHECK-IN, CHECK-OUT, AND ACCESS
- Check-in: from 3:00 p.m.
- Check-out: before 10:00 a.m.
Upon confirmation, the User will receive a booking voucher or email containing:
- Booking holder details
- Arrival and departure dates
- Property description
- Directions
- Key collection information
- Emergency contact numbers
The User must contact the Website Owner immediately if the voucher/email is not received or contains errors.
8. CLEANING AND SERVICES
Cleaning services include:
- Weekly change of bed linen
- Towel changes twice per week
Beach and pool towels are not provided unless expressly stated.
9. MAINTENANCE AND ACCESS BY STAFF
Maintenance of gardens, pools, and essential services may be carried out during the stay by authorized personnel. Fixed schedules cannot always be guaranteed.
10. HEALTH, SAFETY, AND LIABILITY
Users are responsible for their own health and safety during the stay. The Website Owner and property owners are not liable for theft, loss, or damage to personal belongings.
Any incident must be reported promptly to local authorities where appropriate.
Children
Children must be supervised at all times, especially near pools, balconies, and stairs.
11. SPECIAL FACILITIES AND LIMITATIONS
- Air conditioning: repairs will be attempted promptly; temporary solutions may be provided
- Wi-Fi: only available where stated; speed and coverage are not guaranteed
- Satellite TV: availability limited to free channels unless otherwise specified
- Disabled access: properties may not be adapted; prior consultation is required
12. BABY EQUIPMENT
One cot and one high chair are provided free of charge upon request.
Additional units are charged at €30 per week per item.
13. INSECTS, ANIMALS, AND RURAL ENVIRONMENTS
The presence of insects, animals, or rural conditions is inherent to certain locations and does not constitute a defect or grounds for complaint.
14. RIGHT OF WITHDRAWAL
In accordance with Article 103(l) of Directive 2011/83/EU and Spanish Law 3/2014, the right of withdrawal does not apply to accommodation services providing for a specific date or period of performance.
Accordingly, no withdrawal right exists once the booking is confirmed.
15. MODIFICATIONS AND CANCELLATIONS BY THE USER
Any modification request must be made in writing and is subject to availability.
Changing the booked property shall be considered a cancellation of the original booking.
Cancellation Fees
- More than 60 days before arrival: 30%
- 60 days or less before arrival: 100%
16. CANCELLATION BY THE WEBSITE OWNER
In exceptional cases, the Website Owner may cancel the booking due to unforeseen circumstances.
In such cases, the User will be offered:
- An alternative accommodation of equal or higher standard, or
- A full refund if no suitable alternative is accepted
No compensation is payable for third-party services not contracted through the Website Owner.
17. FORCE MAJEURE
The Website Owner shall not be liable for cancellation or failure to perform due to force majeure events, including but not limited to natural disasters, extreme weather, acts of terrorism, or governmental restrictions.
18. AVAILABILITY ERRORS
In the event of a technical or availability error, the Website Owner will inform the User promptly and seek a mutually satisfactory solution.
19. BEHAVIOUR AND TERMINATION
Inappropriate, unlawful, or disruptive behavior may result in immediate termination of the stay without refund.
20. CUSTOMER SERVICE AND COMPLAINTS
Complaints must be submitted during the stay to allow resolution.
